Terms of Service

1. Acceptance of These Terms

By creating a seller account, listing any product, or otherwise using the marketplace services provided by ElectricalTrader.com (the "Site," "we," "our," or "us"), you ("Seller," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of the Terms, you may not list items or access seller functionality on the Site.

2. Eligibility

Sellers must be at least 18 years old, legally able to enter into contracts, and authorized to sell the products they list. Sellers must comply with all applicable laws and regulations.

3. Listing Items on the Site

  • Accuracy: All listings must be complete, truthful, and not misleading.
  • Exclusivity of Offer: Listings placed on the Site must be genuine offers to sell the listed items through the Site's transaction process.
  • Inventory Responsibility: You must have possession of, and the immediate ability to ship, any item you list unless clearly stated as a preorder.

4. Commission & Payouts

  • Commission Rate: ElectricalTrader.com charges a flat commission of 10% on the sale price (excluding shipping and handling). Commission is automatically deducted from the buyer's payment before the balance is remitted to you.
  • Fee Changes: We may modify commission rates with at least 30 days' prior notice via email or dashboard notification.

5. Prohibition on Commission Avoidance

Sellers are strictly prohibited from engaging in any behavior intended to avoid or reduce commission fees, including but not limited to:

  • Listing an item on the Site and completing the transaction off-platform;
  • Directing or encouraging buyers to contact you outside the Site to negotiate or finalize the sale;
  • Canceling or marking orders as "out of stock" to reroute sales off-platform;
  • Inflating shipping costs or using separate invoices or payment methods to disguise the true sales price;
  • Using multiple accounts or third parties to mask commission-avoidance activities.

6. Policy Enforcement

ElectricalTrader.com values transparent, cooperative relationships with our sellers. If we have reason to believe that commission-avoidance may have occurred, we will take the following steps—designed to encourage correction rather than punishment:

  • Written Notice & Clarification – We will contact you, describe our concerns, and request any relevant information or documentation within 5 business days.
  • Opportunity to Remedy – If the issue is due to an error or misunderstanding, you may either complete the transaction on-platform or remit the applicable commission within 10 business days. No further action will be taken once the matter is resolved.
  • Proportionate Measures for Unresolved or Repeated Issues – When a violation is confirmed and not remedied, or if similar violations occur repeatedly, we may:
    • Adjust funds limited to the unpaid commission amount;
    • Place a temporary account hold while the matter is addressed; or
    • Suspend or terminate the account only for deliberate, egregious, or repeated violations.

Our goal is to resolve most situations through communication and voluntary correction. We do not impose additional administrative fees, penalties, or confiscations beyond recovery of the unpaid commission.

7. Termination by Seller

You may close your seller account at any time, provided that:

  • All open orders are fulfilled or canceled in accordance with Site policies; and
  • Outstanding commissions, fees, and amounts owed are paid in full.

8. Amendments

We may amend these Terms at any time by posting the revised version on the Site and notifying you at least 15 days before the changes take effect. Your continued use of the Site after the effective date constitutes acceptance of the amended Terms.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware and the federal laws of the United States of America applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules in Wilmington, Delaware, except that either party may seek injunctive relief in a court of competent jurisdiction. BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.

10. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
